JAKARTA – It is suspected that there were strong actors who created malicious framing, or misled public opinion against the figure of Mardani H Maming as General Treasurer of the Nahdlatul Ulama (PBNU) Executive Board in the case of defendant Dwiyono, former Head of the ESDM Office of Tanah Bumbu Regency who was accused of receiving gratuities for a mining business permit.
This was stated by Irfan Idham, as the attorney for Mardani H Maming in his written statement, Sunday (15/5).
Irfan Idham hopes that the public, especially the people of South Kalimantan, will not be easily provoked by the swaying of opinion that tries to criminalize Mardani H Maming.
“From the beginning, we have said that there are parties and actors who want Mr. Mardani to be involved in legal problems by making a series of opinion polls. There are political and business motives behind all of this,” said Irfan.
“Later we will show and prove everything, just wait, everything will be opened. We certainly still respect the legal process against the defendant Dwiyono which is still ongoing in court,” he said.
Mardani H Maming’s attorney confirmed that there was an attempt to sway a malicious opinion against his client, following the news of a follow-up trial in the corruption case of defendant Dwiyono, the former Head of Energy and Mineral Resources Office of Tanah Bumbu Regency last week.
In the follow-up trial at the Banjarmasin Corruption Court, the defendant’s lawyer presented witnesses who litigated the defendant, one of whom was Christian Soetio who claimed to be the President Director of PT. PCN.
In his testimony at the trial, witness Christian Soetio Christian as the director of PT. PCN, claimed to know that there was a flow of funds to Mardani H Maming from a conversation between the late Henry Soetio and the cashier of PT. PCN related to the order to transfer a certain amount of funds.
The order was then responded to by the cashier of PT. PCN by sending funds to the accounts of PT Permata Abadi Raya (PAR) and PT. Trans Surya Perkasa (TSP). The total is IDR 89 billion from 2018 to 2020.
“The testimony of the witness is not true and seems to corner Mr. Mardani. From this information, the suspicions about the criminalization of Mr. Mardani H Maming are getting stronger. Because the witness is no longer objective and cannot show any evidence of receiving a sum of money to our client Mardani H Maming,” said Irfan.
Irfan Idham emphasized that Mardani H Maming never received the flow of funds as mentioned by witness Christian Soetio.
“The witness has been sworn in so that the witness must be responsible for all the information given. If the statement is not true, there is a criminal threat. We will take legal action against the untrue witness testimony,” said Irfan.
Irfan Idham hopes that the community will be more objective in viewing this problem. There is an evil framing against Mardani H Maming because of the political and business motives behind all this. Later, everything will be open,” said Irfan again.
Not The Matter
Irfan continued that Christian Soetio’s statement as a witness at the Banjarmasin Court was not true and had no legal basis, especially since the sequence of events did not match.
“Christian in his statement has just entered the management of PT. PCN in 2021 after Henry Soetiyo died, so where did that unfounded information come from?” said Irfan.
In addition, Irfan said that the testimony of Henry’s younger brother was tendentious because he conveyed unrelated matters. “What Chistian said is not true and tends to be tendentious, his statement has absolutely nothing to do with the subject matter of the case because it does not concern the company PT. Permata Abadi Raya (PAR) and PT. Trans Surya Perkasa (TSP)
The second thing, he saw that there was an attempt to convey facts that were not true by Christian. “Because Mr. Mardani is not at all in the companies mentioned. So we really object to the information presented by Christian,” explained Irfan, who is a member of this Law Firm Decree.
Mardani H Maming himself attended the trial of this case at the Tipikor Court, Banjarmasin, South Kalimantan on Monday 25 April 2022 as a witness.
In his testimony, the former Regent of Tanah Bumbu explained that he had the courage to sign the decree for the mining business permit because he had gone through a technical review of the defendant Raden Dwijono as the Head of the ESDM Service.
Mardani then handed over the technical mining permit to the defendant Dwijono as a form of delegation of tasks.
“What I checked was the initials of the head of the service. If it was according to the rules, then I signed it. He came to bring the decree to me,” said Mardani H while testifying at the trial.
Mardani said he received the IUP transfer decree at his desk, after first being initialed by the head of the legal division, second assistant, regional secretary, and the defendant Dwidjono as Head of the Tanah Bumbu ESDM Service.
After that, the application for the transfer of the IUP from PT BKPL to PT PCN has also been submitted to the South Kalimantan Provincial Government to be continued with the Ministry of Energy and Mineral Resources.
