North Halmahera – Frans Manery and Muchlis Tapi Tapi is under discualification threat as prospective candidate for Regent and Vice Regent of North Halmahera because of recommendation letter from Bureau of Supervisory Election (Bawaslu) to General Election Commission (KPU) of North Halmahera. It said that couple of candidate prospective have broke the law general election, Monday (21/9)
Bawaslu Law Division, Iksan Hamiru, explained through press release that relating to public report of alleged administration broke violation in Regent and Vice Regent election of North Halmahera 2020, has been handled by Bawaslu of North Halmahera and Bawaslu followed that public report by registering with number case 03/LP/On/Kab-HU/32.07/IX/2020
Frans and Muchlis considered broke the law after giving social assistance to farmer communities but from National Budget Fund (APBN) in Monday (7/9) at Markati Village of West Kao sub-district. Bawaslu have asked clarification for prospective candidate. According to Bill Number 10/2016, Bawaslu has authority to clarify, to examine, and issued recommendation that have to follow by General Election Commission
“According to North Halmahera Bawaslu examination that public report in that case was fulfilled material and formil report pre-requisite and based on yuridis analysis of that case, it was concluded that North Halmahera Regant as an incumbent broke administration law by using athority, programs and activities that prosper and harm one of candidate couple as have been ruled by
Pasal 71 ayat (3) UU 10/2016,” Iksan said
Iksan reminded Bill Number 10/2016 that KPU has authority to cancel the candidacy of incumbent.
“Because it’s nature only recommendation, North Halmahera Bawaslu hope that North Halmahera KPU will take important steps in handling this case fairly and wisely in accordance to ‘election fair election’s and applicable law” Ikhsan added
Meanwhile, Law and Internal Division of KPU, Jalil Djurumudo, said that Bawaslu’s recommendation has been received. In the next 7 days KPU will examine recommendation about Frans – Muchlis violation which reported by Irfan Soekoenae.
